Pennsylvania is among the first states to begin implementation of a Centers for Medicare & Medicaid Services (CMS) waiver called “Selective Contracting.” Among other things, this waiver allows the Pennsylvania Office of Developmental Programs (ODP) to waive individual and family choice. ODP is also developing criteria for Performance Based Contracting (PBC) that allows for the creation of provider tiers. Tier One providers are the winners, as there will be alternative payment arrangements, payments based on quality/outcomes, additional referrals, etc. As for the Tier Two providers … A version of this was previously developed in North Carolina and led to closures, mergers, acquisitions and general turmoil. What happens next in Pennsylvania (the program begins January 2025) is up for speculation but has led to unrest in the provider community. While some may see this as an opportunity, others see it as the beginning of the end.
